I was released by my doctor but when i talked to my employer they said that there were no positions open. They have also hired other people for jobs that i can do.

You might want to check into the state that you live in but I'm pretty sure it's illegal to do that. If you received workman's compensation during this accident then the employer has admitted fault. They cannot fire you for this, you would be placed on a medical leave of absence, paid for your time off work, and then restored you're position after your doctor releases you.

Different companies have diffrent policies and usually if they need to replace you before you are able to go back to work they will --if you didn't get a leave of absence--so then they will say truthfully they have no openings. Doesn't seem fair but this world is not fair.

It depends on if your state is a "right to work" state or not? if it's a "right to work state" you might not get it back. I think kinda depends on the employer and you.

absolutly YES, get a lawyer. they must at least give you the equivelant of your job back. same pay, same hours.
