No matter how many people you kill, you have a right to marry your loved one while serving time in prison. On the other hand, if you are gay, even if you are a wonderful exemplary citizen who has never been arrested, you CAN NOT marry your loved one. Is that OK?

Anyone should be allowed to marry, inlcuding prisoners and gay people.

Religious marriage? Absolutely. In fact, the governemnt has no authority to interfere with such religious proceedings.

State marriage? That's a different matter. Theoretically, a state could make it part of the sentence that the person is not allowed to have any of the legal benefits of a state-registered marriage. But that would have to be done before the person committed the crime, because of ex-post-facto laws.

Remember that religious marriage and state/secular marriage are entirely independent. One deals with your relationship in the eyes of the church, and the other incurs specific legal benefits and requirements.

The U.S. government should never decide who can and can not marry because marriage is a religious sacrament. We haven't quite separated church from State but hopefully that'll happen. So yes, depending on your religion, you should marry whomever you choose, including a killer or including someone of the same gender - it depends on the religion that you belong to.
