O.k. Me and my husband have agreed to split. I am kinda leaning towards it more than him, but he knows he was wrong, so he accepts. We have been together for 9 years, we have 2 children together. we have only been married for a year. We got married on March 4th, 2006. So, my question is this, can we get an annulment? I have been told by a few people that because their are children involved, we cannot. We have to go through a divorce and family court. I dont want to do that to my kids. We both agree on visitations and child support. I have already gottn some money from him, and he has had plenty of visits with the kids. We are trying to keep this as simple as possible and quiet as possible...for the kids. I think they already know too much. But their 2, which really means nothing, cause they know hes gone and things are different, but I just want to keep it simple. I need advice.

You would not meet the criteria for an annulment since you do have children together. However, if you are going to divorce amicably (without contest) you can have a document preparer do the documents for you and you and your husband can represent yourselves in court.

Check your local bar association for referrals to reputable document preparers.

I also think if there are kids involved you do have to go through divorce and custody hearings to see which parent is more capable of keeping the kids but if you didn't have any kids since you've been married under a year you could have had an annulment but at this point i don't see it very possible.

Annulment is most states, because of the kids, is out of the question. However, you can go to a legal assistant and, for a small fee, have them type up divorce papers with the agreement you both have made and have those papers submitted to family court. If one of you show up on the scheduled date and the other doesn't the judge will grant the divorce - nice a quite.

For annulement, you have a window of 30-90 days depending of your state.

A year is too long. You have no choice but to pay a lawyer and divorce. Uncosteted divorce is not that expensive and you don't have to go to Family court to get custody if you agreed with visistation and custody arrangements.

I don't know who is advising you, but obviously they are clueless.

It is very sad that both you and your husband are both selfish and are only concerned about your individualistic needs that you will not live up to and be brave enough to commit to the vows you made. It is sad for your children.
