Yes you need to take it to your local police station and tell them how you came to possess it. If you do not and you know that it is stolen the law they can prosecute you under is the "possession of stolen property" law.

DON'T take it to your local police department - in all likelihood the item was stolen from outside their jurisdiction and they'll do little to return it to the rightful owner, especially if it's a small item like a watch, book or piece of jewelry.

Contact Ebay at http://pages.ebay.com/securitycenter/index.html and let them know what's happened. They will tell you the correct procedures to follow and they need to be informed that they have a seller dealing in stolen property so they can put the brakes on this person as quickly as possible.

If you paid through Paypal, you may get some resolution from them, as well, so you may not have to swallow the full cost of the item you paid for in good faith.

Yes haboring stolen goods is a crime. If you have proof, then you must take it to the police. Then you must get the report from that officer, get with ebay to help track down the criminal. This will show the law you are abiding by the law. Then contact pay-pal if you used them to get your money back, if you didn't use pay-pal, then you will more than likely be out the money that you spent. Otherwise, just get ahold of ebay and report the seller. Any thing that you do to help find the perp, will help make you look inoccent.

Receiving stolen goods is a crime. You can avoid prossecution by turning over the items as well as all documentation you have to the proper authorities.

Take, for example, the recent events with Steven Spielberg.

If you knew at the time that you bought it that it was stolen, you have received stolen property. That is a crime.

If you found out after the fact, you might not have to return it. Check out the laws in your jurisdiction or consult an attorney.

Do you HAVE to return it? No. Can you be arrested for being in possession of stolen property? Yes. You are now a party to the crime. You decide what part you play.

Ebay, I often wonder why anyone would buy a pig in the poke. If it's a hot item, better return it. It took my son in law getting screwed three times to quit buying on bay. Some people never learn and just keep throwing their money away.
