Definitely report to the health department. You have a strong case. You lanlord needs to provide sanitary conditions.

Report them to the Health Dept. There are guidelines and rules for how many bathrooms a business or public location has to have per person...if the landlord can't guarantee that then you may have yourself a case with the Health Dept. You may want to research your local guidelines before you call.
