If the person you are getting it from will not warranty it, you should be worried. They all look the same once the outside is cleaned. Just because they say it is rebuilt does not mean that all the parts were changed. Once you buy it without a warranty it's yours!!

You don't tell us if it is Auto or Manual, or what make/model.
You run a risk of spending some good money after bad. That said, a used transmission is significantly less expensive than a rebuilt. If it works, it is probably good.
If the shop that is doing the work is providing the unit, they will be at a loss if it doesn't work,, because they get to do it again for nothing (or should).

Where are you getting this used transmission from? If its a junk yard or something someone is selling you privately you can't really know. Same with an engine, I had a engine in one of my cars replaced and it was from a junk yard.. spent $2,100 to have it done and the main barrings went in it less then a year later. Now the car is sitting out in a field rotting away.
If your going to replace it I would suggest you fork out the money for a good one (not one thats been sitting in a junk yard) and make sure they provide you with a good waranty.

Yes here we go again... You don't.... Make sure you have a guarantee with it, only i would add one thing here, so many people are under the impression that a gearbox never needs an oil change? Believe, have it changed least every two years, and if you have an automatic transition, chances are, you getting ripped off, Automatic repairers are such an easy touch for garages these days cos there are so many components they can charge for that you have no idea if its gone of not. Have someone you can trust look over it first. You don't actually say why your having it changes anyway, that would be very useful. Edx

You don't it might last 1,000 miles or not, if it is used and there is no warrenty you better get it cheap and remember even if it is cheap there is a lot of $$ in labour to change it each time.
