Go buy another one from them and this time make sure it is brand new. Then put the old one in the new box and return it for a refund. Stick them with the loss.

First I would say be absolutely sure that you didn't think you were buying a brand new game but accidentally bought a pre-owned game. I guess what I'm saying is did they intentionally sell you a pre-owned game and advertise it as new? We deal with EB Games a lot and I've never had an issue with them however if you paid for a new system and got a pre-owned one that isn't right and you should be compensated. Did you pay with a bank card so that you can print out your bank statement and prove you paid the price that they charge for a new system? You should always keep your recepit I say get a little folder and keep receipts for everything you buy in there.

You could get a lawyer and file a $4,000,000 lawsuit over emotional distress and severe depression. Knowing our judiciary system you'd probably get the money forever putting Gamestop and EB games out of buisness.
