I made a deposit in October 2006 for my child to start at a Montessori school in Sept 2007. In Jan 2007, we changed our minds, and asked for a refund of the last month's tuition (I don't mind forfeiting the registration fee). The contract says that both the registration and last month's deposit are non-Refundable. I signed the contract. I have written a letter demanding refund of the tuition deposit on the grounds that they can offer the place to someone else and they have not offered any service in exchange for my deposit. I am also threatening them with legal action through small claims court. Do I have a case?

I guess my question is whether I can challenge an unfair or unreasonable term in the contract.

Well you can try, but unfortunately you signed a contract. You obviously understood at the time you signed it that it was non-refundable. Contracts are legally binding. You cannot just get out of it now because you feel like it. Think about that in the future before you sign anything.

i do no longer think of you may undertaking this one, regrettably. You signed a legal record asserting that the money replaced into non-refundable. you will finally end up spending greater money attempting to undertaking this than you would be able to get decrease back to you. regrettably, the perfect ingredient to do is circulate on and forget approximately it. they do no longer could desire to furnish you the money decrease back even in the experience that your spot is replaced by way of somebody else paying training. when you consider which you signed that record putting forward non-refundable your risk is incredibly plenty 0. and that i do no longer think of you may attempt to declare that it rather is an unfair or unreasonable settlement term. A non-refundable deposit is incredibly effortless and that i do no longer think of a choose might locate it unreasonable.
