I recently graduated college in FL, and have not yet changed my residence from VA to FL yet and the whole last year Ive worked in FL only. My family is concerned I may have to file taxes under VA or something Im a bit confused maybe someone can help me.

The real question here is where were you at the end of the year? If you graduated in 2006 and lived in Florida under the pretense that FL was your new home (whether you changed your driver license or not), then you might have the argument that you were a Florida resident for tax purposes.

I've actually seen people argue the opposite, moving to a state for three years claiming it to be a temporary position.

Of course, this all depends on what both VA and FL laws say about your primary domicile. (You'll have to check state instructions for this).

If you can establish that you were a Florida resident for tax purposes, then you wouldn't need to file in Virginia. If you can't, they you will need to file and pay taxes in Virginia based on the state laws in place for 2006.

If VA is your legal domicile they are entitled to tax you on your world-wide income. You must file a VA resident tax return and pay any taxes due. If VA taxes weren't withheld from your FL income, you are required to make quarterly estimated tax payments to VA. If you didn't, you may have additional penalties and interest assessed for underpayment of taxes.

If you were a student and went to school in Florida then you did not possibly give up your VA residency. You would have no state tax to pay if you decided you were a resident of Florida for all of 2006 as there is no state income tax there. If you had a Florida address then the wages earned in Florida would not be reported to any other state anyway.

If you have not worked in VA you should have no taxes to file for VA. You will only file FL state taxes.
