I have a 17 yr. old daughter who has been living with me for over a year now. When her father and I divorced in 2003 she wanted to live with him. Things didn't work out and she came to live with me. We have never went back to court so I could have custody of her. We didn't pay each other child support because one daughter was living with me and one was with him. The daughter that was living with me is now out on her own. This just leaves my younger daughter with me now. In a year, he has never supported her financially. We don't really have the money to hire a lawyer to take him to court for support and custody. What do I have to do to file papers on my own? Where do I go to file papers?

no lawyer needed, you just file the papers yourself and the court goes by incomes (not expenses) of both parents, and number of children in the case (not new ones he may have made).

its very simple, just contact your county court clerks office and ask where to apply for child support. call them and ask how and were to file the papers. if its pro se, its easy. they will walk you through it

today, they go by both parents incomes... so with the cs calculators i put here, just click on your state and fill it in.

the best advice i can give, is make sure you go back when the child is done school... for the child support to continue while she is in college/trade school. most states do that today. also, learn all you can on the subject, LEARN IT ALL.

The courthouse in your county will have the forms for you to fill out, and also maybe be able to get you some help by some family advocacy groups. The paperwork may seem complicated, but it is best to remember to keep it simple. You are going through without an attorney, and courts give allot of latitude (Lets you get away with things a lawyer could never dream of), so just keep it simple.
Also, let your ex-spouse know that you are not hiring an attorney, that way if he does hire one, the attorney will have to let you know so you don't get surprised when you do go into the courtroom.

Go to your county building, there should be family court or family services. This is where you would file for custody. You could also call them and see if they will send them to you. I do know in NY that you can get child support until your child is 24 if they are a student. Good luck

You only have one more year to go to collect support (hopefully, unless you are in one of those silly states that say a parent has to send a kid to college) you managed with the other daughter, why can't you just support this one yourself too? He could have made you go to court to make him hand her over. You could just ask for a little help from him, but then you might actually have to be civil.

try the dept of human resources in your community...I was once in a similar situation....never filed papers or anything...but since your daughter has one more year till her 18th birthday (assuming)..then some support is really warranted. do what you think your heart is telling you to do...good luck
