Are there any side-effects of applying for child support through the state program to do this? My children were born out of wedlock (husband is English and doens't believe in marriage). Will he gain rights to the children that he doesn't have at the moment? At present I have sole custody, as I live in a State where even when you marry after the birth, the mother retains full custody if the children were born before the marriage.
I have heard that my husband may gain rights to the children that I will regret if I claim child support. Is this true?

Some men take out custody cases in revenge, try to take the children away, if you apply for child support. I am not trying to deny visitation. Men who have paid child support appear to bear grudges, from some of the answers I have got!

He will get visitation rights. Visitation rights are not custody rights. The child support depends on the amount of time each parent spends with the kids. If the kids spend most time with you, then the amount of child support is bigger. If they are going to be with him on weekends, or some other days, you will receive smaller payments. You do not have to worry about custody, because you already have the sole custody. It will be hard for him to challenge that. Maybe if he does get the visitation, he won't be coming or will stop coming to see the kids after few weekends anyway.
If you apply for child support through the state program, you probably won't receive the kind of amount that a lawyer will get for you. But lawyers are only worth hiring if your husband has large income. Try to do it through the state program first. State programs are efficient.
Absolutely file for child support! You have to do it for your kids.

If he is the father then he already has the right to petition the court for visitation or joint custody. A lot of men will fight for visitation when they are served with child support orders. some do it out of spite. If he is not endangering the children though, you should want him to be a part of their life right????? I believe that you will suffer later if you withhold the kids from him now. I think if you really need the money in order to support the kids, go apply, but even if you don't need it or just choose not to apply, keep in mind that all children need their father in their life. good luck and God Bless you and your children.

The state you live in makes the difference on what the laws stipulate regarding the dad's rights for kids. Actually, as long as they are proved to be the dad of the kids, they have the rights of the Mom if she gives them that availability.

your right, some men do fight for custody for revenge or not to pay support. to some guys, money is their God.
he has rights even if you dont file for child support. but since the state doesnt know about you, and there is no court order proving he is the father... he has no rights at this point.
once he is proven the father (the court will order a DNA test in most states), child support will be calculated.
custody and visitation are separate issues. he has a right at that point to visit his child, unless he is proven some sort of threat/danger to the child (crime history, drug record, abuse record, etc).
