Why my son has to pay for his university because he was born in England but if you are born in Scotland you don't havre to pay.
Why Students union don't take the goverment for judicial review and even then to European court of Justice. If this is not discrimination I don't know what it is. Of course Mr. Brown will say well,Scotland is a diffrent country when this suits him.

Scotland has partially devolved government, so their rules are different. It doesn't seem fair but England cannot afford to pay for all its students anyway.

Well, to start, any Scottish person wanting to study in an English university must also pay fees. Scottish students only don't pay fees if they are studying IN Scotland.
The reason for the differences is because Scotland has it's own, devolved, parliament, which can make key decisions on various matters, including the issue of further education & related fees. Scotland has a completely different education system from the rest of Britain (it always has done).

Does it work in the reverse, as in, if your son was in Scotland and born in England, would he still have to pay. If you don't like this Mr. Brown go over his head.

When I first saw your question I noticed you asking "is this fair" and it was in the law and ethics section. I immediately thought of the answer 'No'

It would have been the same answer if your question was in politics. The government does what it does and it is rarely fair or ethical.

I think it is fair mainly because English students will get more from their education if they have to pay for it, rather than waste time on 'nothing degrees', drinking and partying.

If he pays he will be able to ensure he gets his moneys-worth, or yours as the case may be.
