Just a hypothetical, I was debating this with someone. If a cop went on craigslist attempting to sell drugs, and, claims to not be a cop, if someone bought it, would this be entrapment? P.s. I realize cops proabbly do not do this.

This is a very good question and a debatable issue but it is easy to know. There is very thin-line distinction between entrapment(lawful) and instigation (unlawful). The difference that in instigation there is an element of coercion or force that command someone to commit the unlawful act. While in entrapment the (there must be an authorize person to do that) action of the undercover must be lawful in the sense that it is an official and documented operation of a proper government agency.

On the case at bar, assuming it is a cop, authorize to go under cover and sell drugs then the place to sell is immaterial (craigslist) for which it is an authorize operation. There was is no coercion nor force the public to buy illegal drugs but it is a personal act of the buyer to do so and such act of buying illegal drugs is definitely a crime not to mention if you posses the substance.

Therefore, it is entrapment and it is lawful not that classify as instigation or unlawful.

No. Entrapment is enticing someone to commit a crime that they were not predisposed to do.

An example of entrapment would be if you were offered $1000 to buy drugs for someone, when you returned with the merchandise you were busted for possession and/or dealing.

Police officers are not prohibited from denying the fact that they are police officers while working "undercover", and doing so does not create an entrapment situation.

If someone advertises something illegal and you or whoever answers on their own, that isn't entrapment. How there are limits to what they can do! You would have to prove you were unwilling to commit the crime and that you never really did. It's how De Lorean, the "car" maker got aquited.

Entrapment is where the criminal intent is induced by the police into someone who would not otherwise have committed the crime.

If someone would otherwise have committed the same crime with someone else, then it's not entrapment.

you can bet that anyone selling anything illegal on the Internet is a cop looking for unsuspecting people, regardless of whether they are a cop or not, lets say you did do this, you are now involved with trafficking and depending on the quantity maybe intent to distribute let alone the possession charge

No, it would not be entrapment. What you're describing is basically undercover work, and actually, thats what they use in "To Catch A Predator" A cop working undercover on a computer.

Nope.

People misunderstand "entrapment". And indeed various police departments around the country use "decoys" to provide apparently legitimate (but illegal) tangibles all the time.

Sex offenders, for example, are drawn to "14" year old girls, and the like, with offers of sex.

Is it right? You decide. But it is legal, usually.

I am an innocent not part of the traffic but people have tried to set me up through word of mouth from my uncle rene who set met up with his girl friend by trying to give me the evil eye and 2 lebanese brothers who are dealers waiting at a bunnings store with the mafia from around sydney looking at my leg moving there speed in carva looking and waiting for a sign a weakness to as my uncle is a speed freak who was followed for years by private investigators who got people busted in penrith area .Now i'm anti drug all i want is to destroy the drug because it interfered in my life. they even used propaganda over bunning PA system .Now everybody has rene's saying Ya bastard sydney. i'm for life .My uncle is crap speed/coke/endone freak.Hang mans noose in the square in Domain,sydney as let the old men look after the business not the stupid young who destroy the street .
