Native Americans have to adhere to the same laws everyone else does. They pay property tax sales tax income tax all those same as everyone else. They only real tax breaks they get and this is limited to certian areas and to certian tribes is that they may pay cheaper taxes on getting a car tag. The only case of this I know for certian is in oklahoma where participating tribes issue a tribal car tag and SOME not all Taxes are cut out. As to whether it is fair or not well sure it is Im of the mind if you can catch a break anywhere good on ya. In this particular case of the car tags I think it is more than fair because in Oklahoma for example these tribes are the largest employers in the state. So they provide a few Hundred thousand folks with a job, those people with jobs are not sitting about on welfare they are spending money which makes our economy better and they are giving a small discount to a few thousand folks who in turn are going to spend that money somewhere else it pretty much balances it out doesnt it? And by the way its not just native americans they employ either.

The question has me confused. Is this question referring to Amendment 14 section 2 which says "Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed"? This does not give a tax exemption status to Native Americans--this just means that only tax-paying Natives are counted in a state's population and all other Natives cannot be counted. It's a weird stipulation but keep in mind that the 14th Amendment was ratified in 1868 and that all Native Americans were not U.S. citizens until the "Indian Citizenship Act of 1924." (There was a previous American Indian Citizenship Act in 1919 which allowed Native American World War I veterans to apply for citizenship).

Here's an excerpt from chapter 13 of the "Handbook of Federal Indian Law": "The use of the phrase 'Indians not taxed' in the provisions of the Federal Constitution relating to representation in Congress has given color to the popular belief that tribal Indians are exempt from taxes. Whatever the situation may have been when this phrase was first used, it is a fact today that Indians pay a great variety of taxes, federal, state, and tribal."

There is no umbrella federal tax exemption covering all Native Americans. There are tax exemptions but they are very specific. An example given on the IRS website is "IRC section 7873" which exempts income from "fishing rights secured as of March 17, 1988, by a treaty between such tribe and the United States, or by an Executive Order, or an Act of Congress."

State taxes are another matter. Under certain circumstances Native Americans are exempt from state taxes. The most obvious example is the state income tax exemption which only pertains to documented tribal members residing and employed on their tribe's reservation. I stress that this exemption applies only to those Natives working and living on their own tribe's reservation. It does not apply to Native Americans living on another tribe's lands. It also does not apply to Natives commuting off-reservation for work.

Tribal governments themselves are exempt from tax just like state governments are exempt. Tribes can levy taxes similar to a state. For example the Navajo Nation has a sales tax and a fuel excise tax as well as other various business taxes.

What is "pay for tax"? Do u mean they don't have to pay taxes? I don't even know the answer but I would believe it and think its fair. Let me ask you if you think it is fair that the people who lived on the pristine land mass now referred to as the United States of America had it taken away from them after being here for generations. Then moved to desolate desert reservations to live in humiliation, their spirits shattered, never to be proud again. How did Columbus get credited in "discovering" America when there were already some 6 million indigenous people living here?

do you know your history about what happened to native americans ("native" being the real inhabitants of north america) silly colonists decided to snatch land from underneath them and told the natives to eat **** and die. the no tax thing is just an old reminder of colonists' cruelty. how could YOU decide what's fair?

i think its just fair. if it werent for the europeans coming here and taking everything like it was theirs, the natives would still be here cultivating this land and the land would be thriving. not falling apart with grey skies and a hole in the ozone layer. :-D
