And also, If my wife is not a U.S. citizen are we legally married in the United States?

Talk with your lawyer. The lawyer will be able to explain that she may delay the divorce, but she cannot stop it. With this said, she must not want to get this divorce. You may wish to take this opportunity to ask yourself if this divorce is what you want. If you don't want this divorce, try marriage counseling. If you do, good luck.

Yes, you are legally married in the US if you are legally married anywhere else in the world - whether or not either one of you is a US citizen. If your wife doesn't agree to getting a divorce that simply means you will have to have a judge grant the divorce (as opposed to entering into a stipulated judgment or agreement). Once he has ordered the divorce, she can't prevent it by not signing. If she will not participate in the divorce process (won't go to court, file a response, etc) then you will have to take a default divorce. These can be tricky so I would suggest consulting with a lawyer.

If you are a U.S. citizen then yes your marriage is legal in the U.S. As far as what to do if she doesn't sign...that depends on the jurisdiction of the marriage/divorce. I suggest you check with your lawyer.

You need to ask your attorney about this.... If there are children involved she may have to sign but i am not exactly sure. Why do you want to divorce her if i may ask? I think you can divorce nowadays for most any reason and the other person does not have to sign but like I said ask your attorney first to make sure of this in your case. Be sure to check the divorce laws in your state and area as well and this may be of some help.

it depends on where you live, where I live you can file what they call a Default Divorce and only one person has to sign, go to this site and look up the laws for your state....it's free and the laws are all listed.
