People say you can get a divorce for any reason but I want it to be stated that my reason is adultery. I know I'll need proof so can someone tell me if I have enough for my filing to be b/c of adultery? 1.)receipt from Victoria's Secret where he bought 3 pairs of underwear(thongs) & a size 36D bra.(I'm a 34B) & the tags as well. says they were for me but he took them back.(but yet still has receipt, etc.)2.) a receipt for a restaurant where he bought a large pizza & 4 drinks.(he says only him & our son went...my son says 2 girls went w/them-even rode in my husband's truck w/them. I have proof I was working so it shows I wasn't w/them)3.) bank statements for the last months when he's been "working on weekends"..statements show restaurants, movies, etc. 4.) from 3 years ago..phone statements from him talking back & forth w/his ex5.) pics of him w/other ex & love letters from her from after we got married. Is this enough for the filing to be b/c of adultery & hold up in court?

You can list adultery as the reason for the divorce but wont be asked to prove it. Divorces are so numerous nowadays that the judges dont care whybut just give them out. So all of this proof is only self justification for yourself, but by the way really doesnt prove adultery as the courts would define it, sorry.

Why stay in a relationship in which you're being cheated on for the sake of getting proof? Just the the divorce.

If it's a matter of getting more "stuff," then get a GOOD attorney and get the disso filed. In the time it took you to type up this silliness, you could have scheduled a consultation.

Get your priorities straight and get your poor son out of this mess! WHY did YOU wait so long???

You definitely have enough proof to accuse him but unless he admits to cheating or he's caught in the act you will probably have a hard time trying to convince the judge of adultery. If you are serious about this gather all your evidence and find a good lawyer.

Courts no longer allow adultery as grounds for divorce. In order for it to hold up you would also have to prove physical abuse, mental/emotional abuse and add them to the adultery charge and it becomes "cruelty" However keep in mind that you have to have irrefutable proof of abuse, such as hospital records, police photos, witnesses to the emotional/verbal abuse. You can't just go in there and toss what you have at the court ...they'll laugh at you.

i do not think the courts even care anymore who does what to whom, most states have a no fault divorce now, know it hurts and cheating is never right, but the best way to get out of a marriage is to leave with the least amount of trouble, and with your dignity. theres no punishment anymore for adultery, he probably is cheating on u, but the courts simply don't care much anymore about it. i know this hurts but best to just leave the marriage, get your child support and go on with life. divorce is never easy and it hurts like heck, but the more u try to hurt him the more your going to hurt over it.

No it is not. All you have is 'entertainment' evidence of dining and such which does not constitute actual "adultery." They could argue everything from he was planning gifts and parties for YOU to who knows what. You need to hire a detective and PROVE that they are actually having sex to file under "adultery."

None of that will wash in court-adultery is rarely used anymore-go for cruel and inhuman treatment!

honey i'm sorry but i doubt that would hold up in court even though i agree with u it sure sounds like he's messing around on u for sure i would say dont worry about the divorce saying because of adultry and get ur divorce and get rid of the bum and go on with ur life

I wouls say the only real proof is the love letter and picture if you can verify the dates on them.
