but my son is very smart to be 5 he no right from wrong he is in school A one child i never did any then to make him think been abuse me and the father is togather still. my son got more then some 5 year old.

It's not against the law to hit your kids. It might have been the wrong approach though. You can't do anything now about hitting him but maybe talk to him about the situation. He is only 5 and knows right from wrong but maybe he didn't feel that the child was touching him in the wrong way. Just talk to him about it.

Your writing is very confusing. It sounds like you or the child's father might have been accused of child abuse. If this is the case, this is a very serious charge. In the United States it goes with out saying jail time could be in your future. I would find a lawyer.
