It should rest with the people...
hoever it rests with the supreme court, apointed by the presidents, confirmed by the congress, elected by the people.

The power of the supreme court has been expanded too far in my opinion, judges can now be activists on the bench

Well these days it's the US Supreme Court, although LEGALLY it's Congress that has the final say. The US Supreme Court LEGALLY does not have the right to make law. But people seem to forget that.

Drew is correct, Congress makes law, the Executive branch enforces it and the Judicial branch interprets it's application. Only these days Congress just wallows about aimlessly while the Executive Branch breaks Constitutional Law and the Supreme Court of doddling old fools usurps power. Yes neo-cons, we do live in a dictatorship and as soon as Brittney goes to rehab and stays there the overthrow of Democracy in the US will be news.
