Back in july of "06" my brother was living in a house with his friends well the house got broken into and my brother got beaten up pretty bad by the people who broke into the house well they called the police and when they were looking over the place apparently his friends were growing weed plants in the basement and apparently the house is within 1000 feet from a school well they didnt arrest him nor did they tell him he was being charged so afterwards he came to live with me in ohio this happened in florida well just last night his friend got pulled over in florida with him in the car and there was weed in the car no one would admit it was theirs so they all went to jail keep in mind his name was not on the lease to the house nor did he own the car he was just there welll they are charging him for these things he's only 19 years old is there anything i can do they put 25000 bond cause they thaught he was running cause he didnt know about the first court date. what can i do????

OK. I'm assuming you said they arrested him for the pot from the house and the car. Obviously, they investigated the house and issued a warrant for his arrest and the other inhabitants. He doesnt need to be on the lease to be responsible for growing the pot. The cops just need to determine or believe that he was responsible for growing it or otherwise conspired to grow it. Being in the house doesnt make him guilty, but it does give the cops probable cause to arrest him.

As for the car arrest, the fact that nobody admitted to it being theirs is the reason everybody in the car was arrested. If this actually went to trial, the proximity of each person in the car to the pot would be important to determine who was in possession.

So the short answer to the question of your brother's culpability is yes. He may have criminal liability here. He's obviously hanging out with a bunch of stoners. It's highly unlikely that he's not getting high with them or that he really didnt know anything about the pot in either case. He's 19 and probably isnt being 100% honest with you because he's scared. But you have to consider the possibility that he's guilty to some extent.

If they wanted a 25K bond in Florida, you can assume that the charges are serious and you should hire a good criminal attorney. It might be expensive, but if your brother is innocent, you need to get him a good defense. If he's not, it's even more important. This is a serious criminal matter that must be dealt with professionally. Not here.

You can get an attorney, because this is a complex situation.

The people who leased or owned the house where they were growing the marijuana could be prosecuted based on that status. As far as the car incident, the police would need to prove who was in possession. Both are heavy factually dependent situations with lots of tricky subtle legal issues.
