my husband and I were kicked out of an apartment complex about three years ago, were never got an eviction notice, we were just kicked out one morning. Well though we were never sent a bill or allowed to have one from the office we were told we owed $2500. Needless to say we never got anything saying and we only found out about a year ago that we have a judgement for that same amount. We can't get into a place to live (we've been living with his parents) because of this judgement, and now that we have the money we've been told that the collecting company no longer exsists. So now what are we to do, is there ground for dismissal? Can anybody help? Who do we pay since it is a civil matter?

How were you "kicked out" without getting an eviction notice?

Physically dragged out? Locked out when you were gone? Verbally told to leave?

The judgment would have been entered by a court. If you never appeared for the court proceedings, then the judgment was probably entered as a default.

If you were never notified of the court proceedings, then you can challenge the default. If you're willing to pay the amount, then you can notify the court that the other party won't take your payment, and ask the court to intervene.

Some of this gets into tricky civil procedure areas, so you probably should speak with an attorney licensed in your state.

Since you weren't physically handed the form,I believe it had to be dismissed. You need to go to the court and tell them that you never received the forms. Since you were kicked out. Speak to a lawyer,to find out for sure.

go to your local courthouse and tell them you want to pay to have a lein released and cannot find the collection company. they can advise you what to do. did you try to call the appt complex or pay them directly?
