My friend's soon to be ex is charging her for sex. When they first got together it was a joke between them that every time they did it she should pay him 15 bucks. When they split 10 years later, he stole her journals where she wrote everything down (including when she had sex) he now claims that $23,000 he's suing for is for household items he left behind. Coincidence that they did it 3x week for 10 years??

It's gonna be nasty, but put ALL the cards on the table with the lawyer, judge, whoever...............If he was charging her for sex, which is so wrong on sooooo many levels especially from someone who is supposed to love you (we are talking 10 years)...........seems to me, they are even......it's called abandonment. If he left his stuff there, then decided later, that isn't kosher. I'd love to be a fly on the wall when he tells the judge he was prostituting himself to his girlfriend/wife.

Nonsense. Demanding money for sex would be prostitution, hence illegal in most states - kinda like suing a guy for stealing your pot...Never mind that they were married, so ther cannot be a "charge" for sex. Tell her to charge him $1 for each time she had to pick up his stinky socks, wipe his pee of the toilet or replace the roll of toilet paper he emptied. They should come out about even.

I don't see a problem here. That is the bedroom parlor game that she consented to play. She doesn't have to play that game, you know? As a matter of fact, she doesn't have to ever have sex with him again. He does have a right to counter sue. It doesn't mean that he will win, though. But, he does have an obligation to return her diaries.

Considering they were together for such a long time, he probably is just going after what he thinks is his or at least half his. She needs to check into the common law issues in her state.
