Didn't know under what else to ask. I live in a mobilehome park, owner gives us all (55+ community) notice to be out by August 2008, untill then he will decide if he wants to sell to developers to highest bidder, upgrade the park, or sell to us residents. I own my mobile home, I bought it from the owner September 2005 @ $6,000 I asked and was told when I purchased and moved in that he had no intentions of selling, that he loves mobilehomes and would never sell. I along with a majority of the residents, home is too old to be moved therefore have to leave it behind,. Question is, because I own the home and rent the lot can I get away without paying rent and not have the owner put locks on it to keep me from entering, how long do I have? I would like to get the $ back to purchase elsewhere. What can I do and he do legaly? or not.

A talk with a lawyer will cement any advice you receive on a board like this. It would seem however that several things dont add up here. If he did intend on selling you your space thern he wouldnt have already mentioned a move out deadline. It is unlikely he can or will sell the park to each owner. Nothing can really stop a person from changing their mind after years of owning a park so he could just be tired of the entire place. A better idea, in my way of thinking, would have been for him to have a parkwide meeting. He then could have informed the occupants of his intention of selling out and offered from the proceeds a buy back of the trailers he sold to residents. As far as non payment of space rent it seems that placing a lock on your personal property would be a violation of some law. If anyone there has in writing a draft with him guaranteeing the place will remain a trailer park perpetualy get a copy and use them as a witness. You land the other tenants likely have no legal grounds to stop him from selling but to get any court sympathy you must remain in contract compliance and pay the space rent. Maybe it will turn out the zoning or some other issue will kill his deal.
