However, if he enters the US on a tourist visa, or on a visa waiver, with the intent of getting married to a US Citizen, that is misrepresentation, visa fraud, and a crime.
However, proving intent is very difficult, which is why many inspectors scrutinize very closely. For example, if your fiance has a round trip ticket, with a return trip in two weeks, and yet brings two large suitcases with lots of personal items (like family photos, college diplomas) that one does not normally bring on a vacation, then a red flag is raised in the mind of the inspectors.
Also, there have been precedent decisions in Immigration cases involving a foreign spouse or fiance of a US Citizen, where an intent to stay in the US is presumed. If under questioning your fiance admits that he is engaged to marry a US Citizen, the inspector could deny entry to your fiance.
Foreign travelers have been denied entry on the basis of having love letters from their US fiancees on their person.
If your fiance is successful in convincing the inspectors that he has no intention of staying in the US, you can get married. You will have to file a petition for your new husband (Form I-130), together with an application for Adjustment of Status (I-485). Note, that you new husband won't be able to leave the USA while the petition is in progress. Well, he COULD leave, but it is likely that he will be denied re-entry. Approval of the petition takes a little over a year.

No, that would be a mistake. You must first apply for a fiance visa, which must be granted while he is living in his own country. Then he can come to the US (or you can go there) for the marriage. After he has the visa, and then you are married, he will be able to live in the US while you get his green card processed. Note this is NOT automatic anymore - he'll have to apply (with you supporting the application) and there's a good chance, but no guarantee, that it will be granted.
Sorry to say all the earlier answers are wrong - please check with the Immigration Service before doing anything. If you get married without getting him a visa, it will just get more complicated!

Technically yes, but it's not a great idea to get married on a tourist visa (or visa waiver.) While you could do it, and then let him go home, and apply for a K3 visa, getting married on a tourist visa (or waiver) can often raise eyebrows, and complicate the immigration process. A better option, since you want to get married is to apply for a K1 (fiance/fiancee) visa, and get married when that visa is issued.
