Hey,
I hope you neither have this nor are involved on either end of this but there have been several cases where a person has been charged with offenses like "wreckless endangerment". This was charged when one person knew that they had AIDS and did NOT tell the other and engaged in unprotected sex. If there is proof that the one w/ the diease had knowledge (such as a medical record, treatment, etc.), it may be admissible in a civil or criminal proceeding.
By the way, a criminal charge is not limited to just having sex. If a person is needing medical attentions and doesn't inform the medics, they could be charged as well (http://query.nytimes.com/gst/fullpage.html?sec=health&res=9D0CE2DF163BF931A35755C0A967958260)

Well technically no, but if they catch it than they could file a civil suit against you for willfully commiting harm. Meaning you know you are endangering their life but still do it. You would have to pay for the rest of your life. Please use condoms! don't give oral sex! and don't pee on the seat so little ones in restaurants sit in it. All of these are ways of transmitting it. Also I think you should not have sex until they know, if they dont want to than you know they aren't for you. Maybe you will find someone with it too and can be together but how will you know if you don't voice it.

In many jurisdictions, it's illegal if you don't inform them, and if you have sex with the intention (or reckless disregard) to infect them.
But consensual sex, based on informed consent, is still legal.

You could potentially face prosecution for having unprotected sex with someone and you do not tell them of you + HIV status.
It could be charged out as attempted murder. It has happened.

I believe that you must disclose that ..if you do it without protection...some states have prosecuted in criminal court....but CHECK WITH A LAWYER...I am a PARAlegal and am giving a nonlegal opinion...

I've heard that it is "premeditated murder" if you know you have AIDS and don't tell when you have sex.
