In a place where such gladiatorial contests were not illegal, would it be moral for two persons to freely consent to participating in a duel to the death?

Since you qualified your question to allow such a dual to be legal, then it does become solely a morality issue. For me to agree that the fight to the death would be moral, it would require that each of the participants be an orphan, unmarried or without a mate, childless, without siblings or other close relatives or friends who would be traumatized emotionally by the losing combatant's demise. Morality, in my view, embraces the concept of doing no harm, including emotionally and spiritually. If the above criteria were all met, indicating that no one would care which fighter won nor grieve for the loser, then they are welcome to fight to the death if that is their pleasure!

I'm not sure why others that answered couldn't grasp the idea that you were referring to a 'what if' idea of this being a legal activity.

Anyway, legal or not, it is immoral because the outcome is murder on someone's part. Killing another person should only be due to protection for oneself, or protection of someone else.

Let's not let the government decide what's moral...(Bill Clinton).

Morality is defined by religion and culture.

In some religions and some societies, it's not only moral but it's expected in certain situations. In others, it's immoral.

There is no single answer, unless you are asking within the context of a particular religion and a particular culture.

Morality is something we determine as individuals. We have no courts of morality (that's what church is for). However, it would be illegal. The one who lives would be guilty of murder.
