The lady was injured from the fall but no surgery was required. We contacted her to see what we could do and she wanted us to "make an offer" in means of settling out of court. We would agree to pay for medical purposes but the lady is wanting more than the medical. In my opinion she should open her eyes when she walks. Any input would be appreciated.

New Detail: The "Construction Site" was clearly taped and marked off, but the dump truck hauling away the asphalt lost the piece while driving off. The bad news is that the job is for a Snr. Citizen Center but the construction site is taped off....that would be like a rock falling out of someones vehicle that was parked in that lot, and me tripping over it and suing. It just doesn't make sense to me. But we are willing to pay for medical means it was part of our construction site that injured her.

Hate to say it but if the chunk of asphalt was there because of your negligence she may have a suit

Was the area clearly marked off and were there signs stating that people should be aware of a trip hazard? Was the area sectioned off from the public? It is not good practice to let the public go through your company's construction site. It seems to me that your negligent.

Of course she will try and get something out of your company for this, she knows the way the system works. It is easier and cheaper for you to make and offer for her to go away than to go to court with this one.

She playing the odds and playing your company. The problem is that she will most likely win in court. I would see how eager your insurance company is to fight this one, if they are willing to offer, then that tells you something.

Why was she walking around a construction site? You need to provide more information if you want an answer to this question.

you should have offered some payment for her pain&suffering then you could have made off with A small payment now her lawers will have you paying more then was ever needed

...I am not the type of person who would ever sue for something of that nature. Unfortunatly, these days people LOOK for reasons to sue companies...
