This court appearance was originally scheduled for February but got postponed due to weather. It's now been rescheduled for a day we're in Jamaica for our niece's wedding. We've bought tickets and everything already. To come back early just to attend this court appearance would cost us money, not to mention cut our vacation short!

open4one has the right idea. You should immediately contact the attorney or agency who subpoenaed him, and let the attorney know about the conflict. The attorney may be able to delay proceedings based upon that alone. If the attorney will not or cannot do so, then you will have to seek relief from the judge. I would suggest calling his clerk to find out how to put the matter on calendar in order to get relieved from the subpoeana. These things can usually be worked out. However, bottom line, if things cannot be adjusted, he will have to appear--a shorter vacation in Jamaica beats a longer one in County Jail.

He was subpoenaed by the attorney of either the plaintiff or the defendant. Contact that attorney. There are some possibilities, such as a taped deposition, or rescheduling your appearance.

He was subpoenaed because that attorney wants beneficial testimony, he doesn't want you hostile to his cause. There's a good chance you can get this conflict resolved, but simply not showing up is going to have some serious consequences.

That's what "sub poena" means, "under penalty".

Go to the court house, to the court registry office, with a copy of your subponea and your flight tickets if possible, and just explain you will not be available. Such an excuse is permittable usually. Although I do not know where you live and there maybe different laws and regulations. The first thing though is to call the court registry office. They will direct you to who you have to be in touch with regarding the matter.

Write a letter to the court and ask if there are any alternatives.
