at work we are not allowed to have cell phones. my boss assumes that every time i used the toilet its because of texting or talking over the phone; even though i don't use my phone at work. he followed me to the bathroom couple of times and made remarks about cell phone usage and how i'm in there too long. he once ask if i needed an ambulance while i has pooping. now, do i have a lagitimate reason to make a complaint to have him fired or even worse, law suit?

He has grounds to fire you.

If you are spending too much time on the phone, you should be fired.

I would NOT take my phone to the workplace. Leave it in your car.

It will take you months of nonuse for him to get over his perception that you are always goofing off.

Do you have a legitimate complaint? If after not having your cell phone for two weeks (it is in the car, remember), he says something about it - then tell him that you put it away two weeks ago because he said something about it.

Will you get him fired? Not likely - in fact, if I were you, I would be looking for a new job today.

Do you have grounds for a law suit? If you are not texting, or on the phone and they fire you --- probably not. For most companies, they can fire you for any reason (unions excluded).
