Depending on where they got the picture from. If you where able to find that same picture on a clipart program then no. That is meant for public use and most software even gives you layouts for sales ideas with permission to use thier clipart. But if it's from a private collection and/or copyrighted your breaking a plaguerizing law.
Now it doesn't happen often with web usage, but I would still be careful. Especially if you are selling something from the site it may be confused with marketing and for that you can get into some serious fines.

Yes, that could easily be copyright violation.

If someone owns the rights to a work, and you make unauthorized copies of that work, that's copyright violation.

However, if you get permission from the owner of the work (which may be different than the owner of the site), you're fine.

Yes, I think it is illegal if anyone visits your site and knows or cares that the picture came from another site.

If the site says it is copyright protected, yes, that would be illegal. Check with the site first before you commit a crime on copyright infringement.

It may be a copyright violation depending on what you are using it for. You could get sued by the owner of the image.

If you get permission from the owner of that picture, it is not illegel, as long as you put the copyright information with the picture, including whose it is, and where it came from. Picture thieving is a form of plagerism, and should be handled as such, with proper citation.
