I recently fell of the boat at work onto the dock, (I am a biologist and I was taking sediment samples) and injured my back. I have to have an MRI performed because my doctor thinks that I herniated a disc or two, and now I am in tremendous pain, and my right leg keeps going numb on me.
My boss is treating me different and does not have work for me now, and I am nervous that I may loose my job. I missed 3 days because of the injury, and I have been doing everything that I can at work, but I am limited.
Can he fire me or lay me off?
Can he just decide that there is not enough work for me and ask me to not come in on certain days?
I have never had this happen and I want to cover all my bases. Any help would be greatly appreciated.

When I walked into my bosses office to turn in my workers comp. paper work, he fired me. After I handed him the paperwork he just stated oh, and acted like it never happened. Even in court he lied that he fired me.

In theory, he cannot fire you, but in non-tradition jobs like yours, it would be had to prove whether or not the work just slowed down or a form a discriminatory work slow down.

Your leg numbness is a sure sign of a nerve pinch in your lower back. I had L-5/S-1 surgery myself.

I would hire a workers comp. attorney immediately and this will offer your best chance of being treated fairly.

I had a back injury at work back in 2000 and there is no way possible that your boss can fire you or lay you off for getting hurt on the job. He can limit your duties though as long as you are under a doctors care though. Untill you bring a note from a doic saying no restrictions your boss has to protecte himself from further damage to your back in risk of getting sued. I wanted to go back to work but the doc said i wast ready then whe he finally let me go back... i was only assigned jobs that were easy and off my feet like driving a forklift all day. they wont fire you they know better than that.... but as for making sure you dont re injure it again is what they are looking out for. Trust me on this... Be careful.. you only have one back.... You will always feel stiffness and ocassional spasms and pain from time to time... your back will always be vunerable to more injury than ever before and NO job is more important than putting a limit on your daily life functions... If your job requires a lot of heavylifting or anything with back work... be careful...You can always find another job but you will never find another back that will able you to walk, bend pick up your children... and be functional in daily activities most take for granted... even simple ones as walking up the stairs or blaying basketball or football or baseball. i wish you the best!

To tell you the truth i dont think he can fire you and if he dose thats pritty sad. Something must be wrong with your boss anyways dont worry you'll be fine trust me you will
