legally, probably not--- if it is not in your lease agreement. but you are not smart to smoke at all; your smoking harms others
around you and rarely do smokers put their butts in the trash.
the Surgeon General's reports do not give you cause to
stop? THE pain and misery you give others when you
go anywhere and they must inhale this?
rate me poorly if you must but did you know that
a major tobacco maker, 3 yrs ago, offered cigarettes
to a European nation's president because he wanted to
help that nation's budget controller to cut their healh care
costs? HE knew--the cig maker, that his product would
KILL 50% of the smokers before they turned 65.
AND The pain the smokers went through before they ...........

I work for a real estate company and I can tell you that if it’s in the lease they can ask for whatever they want and it’s legal. If and when you renew your lease you can ask to have that part excluded, but make sure you get it in writing!
