You have to get a divorce. Thats all you can do. Why didn't you guys do that in the first place? Probably cause its exspensive right? I know I have a friend that is in your position right now but she is actually trying to go through with the divorce now. If you really love this new man that you've been with for 5 years and want to marry him then you must divorce your husband first so then you can live happily ever after :)

PER US LAW: (DON'T KNOW ABOUT OTHER COUNTRIES):
It probably depends on what the law says in your state. I don't know of many states that just require a title(like a car title) for a spouse. If that is the case, you might check to see if the title needs to be notarized and that he is required to show proof of the mileage he has put on you. Also make sure that he doesn't have to provide a warranty disclosure(no warranty implied or given).
IF HE HAS ALREADY LEGALLY DIVORCED YOU DON'T NEED ANYTHING FROM HIM TO DO ANYTHING WITH ANYONE ELSE!!!!!

Not in the USA
In the US if you want to marry someone else and you are separated but not divorced, you have to get a divorce before you can remarry. Once you are divorced your Ex has nothing to do with who you marry.
