I have a therft II conviction when I was 18 yrs old in 1997. Im in the process of having it expunged by a Private investigator. My question is, will employers be able to see that after it is over with? also when I apply to new jobs what should I state on the application?

It depends upon where you are. In California, what is called an "expungement" does NOT "erase" the conviction from your record, and employers often can find it. My advice to people is to report the conviction, and then add that the case was thereafter dismissed under Penal Code section 1203.4.

ok i have worked for the court system for the last 6 years... when u get an expungement it means that ur record is whiped clean of this offense.. if employers run a record check the only thing that will pop up on ur record is whatever is there beyond that offense.. in the courts they go in and whipe out any information reguarding u, ur name, social security number, address, birthday, race, sex, and other information in their computer system the case is then blackened out with any information reguarding u and placed in an expunged case file... it happened when ur an adult so no once it's gone it's gone... once it's off ur record and u go to apply for a job u don't have to answer that question.. u no longer have that charge on ur record.. if u go through a security clearance it will pop up that u had a case expunged.. if they ask for what u have to tell them but they can no longer hold it against u due to the fact that the courts find u acceptable for the expungement.. though when the case gets expunged the court will give u all the information that u need to know on how to handle these exact situations..

What coragryph said but if you were arrested for it and don't want anybody to see that, you might have to also expunge that your arrest record which is slightly different from the conviction. I didn't know private investigator's could do that? I thought lawyers or yourself had to do it.

The whole point of expungement is that it removes it from your public record. So employers will not be able to see it.

The record never goes away. The public won't see it, but the government keeps it on record. If you ever need a clearance, they'll see it!
