Actually that would depend on the state you live in. Since there are no Penguins naturally living north of the galapgos islands, North america is not a natural habitat for them. Most US Federal Regulations do not allow penguins as pets. That is not to say you cannot have one. If you can prove you have the habitat, the money to support and keep one you can indeed have one. It does involve more than ice and fish. More like a minimum of $18,000 for a natural habitat as well as 2 year supply of food and vet bils. If you are ok with that, I'll tell you how to get one.
Yes in short you do need an exotic license to own a penguin in most states in the US or any country above the equator.

You should not think of a penguin as a pet, They are wild animals that have MANY special needs in captivity IE:temperature controls,specific diet requirements,swimming,mates but most of all they should have the closest thing to there natural environment! and who can really provide that in their homes?the only humans that have contact with penguins should be the wildlife rescue and rehabilitation organisations, zoo's etc but to answer your question YES you do need a licence to have a penguin your home and NO you can't get one unless you are part of the above organisations,IT IS ILLEGAL TO HAVE A PET PENGUIN I know there cute but lets leave wild animals in the wild for as long as we can!

Most likely you do need a licence as penguins are revered and some species even endangered.
It may even be illegal to keep a pet penguin, so I suggest you find out what the state/federal legislations say!

If you live in Antarctica, maybe, but they're protected birds any further North. Even in Tasmania, and the Philip Island penguins are treated like Gods.

Depends on why you want the penquin. If you want the penquin because they are adorable and cute and you think they are cuddly and they would be cool to have.... then i say NO!!!! but if you are an aviculturist and you have rescued the penquin and you know what to do with the penquin and you have plenty of room for a large habitat that will be set to 22 degrees celsius with even colder water and money to pay for food and supplies and medications. and if you don't mind the smell... bottom line i dont think it would be a good idea for you to get a penquin unless you ABSOLUTELY know what you are doing.

since most types of penguins are considered endangered species... yes. (for those species)
Depending on the national, state and local laws where you live... maybe even if dealing with a non-endangered exotic species.
In Texas its legal to own just about any animal as long as you are obeying federal regulations. There are now more tigers in Texas than the rest of the world combined.
