I called express for you and asked them. They said that you may return the jeans even if you took out the tags.
Take the tags with you and do not try to staple them. They will do this at the store. Make sure you have your receipt ready. Remember they do not need an out of this world explanation to why your returning them. Just say " I change my mind".

Probably not. You're damaging them by doing that. Just take the receipt, the jeans, and the tags back to the store and hope to actually get your money. If they don't give you a refund, they'll give you a store credit. If you've washed the jeans, you're probably out of luck though

As long as they do not look worn or washed and you have the tags and receipt, you won't have a problem. Just give them the tags. Don't staple.

They will take the jeans even if you cut the tags off, just make sure to keep the receipt. If the salesperson gives you hard time, ask for the manager and explain that they do not fit and if you can exchange it (worst case scenario, they should give you store credit.)

honestly probally not, mostly due to the tags being off worse case you can sell them on ebay and explain new without tags or NWOT
