I bought a pair of Ice skates off Ebay and they were advertised a size 5 etc etc, When I recieved them it turned out they are actually a size 4 and are of no use to me at all. I have emailed the seller neumarus times over the last 4 days to no avail. Not even a peep from him. No contact number or anything I do have his address though.
I'm am proceding with reporting him to ebay etc but I don't think that will get me very far.

Ok - so they have sold you items as not described so - make sure you emailed him through the Ebay messages not your normal emails so you can prove that as long as he logged in, he would have got your messages.
Four days....now this person could be on holiday/very busy etc. but I can understand why your annoyed. You can go through the Ebay process of reciving an Item not as described - this is self explantory if you go to the help page, and you will enter a dialogue with the seller where you have to sort it out between yourselves.
Did you pay by paypal? If you paid by cheque/cash etc. you may not be covered if the seller is being an idiot - in which case you options may be just to leave negative feedback and resell the ice skates.
If you used Paypal after a certain amount of days you can file for a refund, because they buyer has refused to respond or give you your money back. Paypal will take the amount from the sellers account and freeze it whilst giving you more time to settle the dispute between you. If nothing is resolved they will give you the money back, although you have to file further to say that neither of you could resolve it so you want the money.
So I guess the answer is yes, you can get your money back - IF you paid by Paypal, but hopefully, your seller is just a little tardy.

Go to eBay and file a Not as Described dispute. Then go to PayPal and file a similar dispute. PayPal will usually investigate within a couple of days. Indicate that you're willing to return the item for a full refund, or whatever arrangement you'd like.
Then don't forget to leave negative feedback so others will know what kind of seller that person is.

You were wise to pay via PayPal as this is the best chance of getting your money back. Log on to their web site and file a claim as the item is not as described. If you funded the payment from your credit card this is even better, as you will also have protection from the card issuer too.
Sounds like you have a very strong case, so if you haven't already done so, file your claim today as the sooner you get it started the quicker it will be resolved.
I've used PayPal in the fast to claim refunds and have found them to be quite fast acting. Good luck.

Good luck with your quest, but how did you pay? If by Credit Card over the phone or by Pay Pal you do have some chance of a refund, but if you paid by cash/cheque less likely. Keep trying to contact seller by any means possible, then contact your credit card supplier or Pay Pal. Good Luck.

If you payed with paypal, your transaction is automatically insured. You can go to the paypal website and file a claim, and if the claim is decided in your favor pay-pal will issue you your money back. They should be able to help you work out your issue with the seller, or get you your money back. If you did not use paypal you may be out of luck.

You can post negative comments. The E-bay seller will then be able to respond. Hopefully they will offer a refund. If not you should report them. I would give it a little time...they could be out of town with no internet access.

If you paid by Paypal you can get the money back through them. Otherwise, as you have his address, send him a letter, recorded delivery, asking him to return the money and then you will return the skates, then you will have proof that he did receive the letter.

ebay will help resolve the issue if the item was advertised wrong the seller has to make it right. if you paid through paypal you can also report to them and they will help get your money back.
