I dated a guy for a short period of time in 2005. My son was born 4/06. The guy I have been dating since I found out I was pregnant is wonderful. I gave the baby his last name. He and I are planning on getting married this fall. The bio dad has seen the baby a few times and has never taken him anywhere without me. Now he is mentioning that he wants the baby to have his last name. (we had a dna test when the baby was 4 months) In my state the name can only be changed w/o a court order up until the child is 1 year old. By fall he will have my last name due to getting married. Would you change your childs last name even though the bio dad is rarely in the picture? The only "dada" that my son knows is my fiance. I just don't know what to do.

No - if your fiance is his "dad", and will remain to be, then leave your son's last name. If your son's father really wanted to be a father, then he would have stepped up and really been there from the beginning. Anyone can be a father, but it takes someone special to be a dad.....allow your fiance to be the dad, as he has been, and collect your child support from the sperm donor - he will eventually fade out of the picture anyway.

If the bio father is on the birth certificate, most states use the fathers last name.
In my state, the husband is assumed the father until proven otherwise, but only when the child is born into the marriage and no bio dad has come forward.
Since the bio dad is taking action, I would think the child will have his last name.
How can you change your child's last name with or without a court order unless the bio father has abandoned the child and is no where to be found?

I would stick with the way you have it. Now if the bio dad is really to pay child support only then would I consider changing the baby's last name. For future reference never give a baby the last name of someone that's his legal father. The baby could have went in your last name. Get this matter settle before the kid starts school.

The biological Dad has seen his son only a few times in almost a year? It sounds like your fiance will be the child's father, leave the name how it is.
And congratulations for finding such a wonderful and supporting man to spend your life with!

I wouldn't change his last name since you are getting married, that way the baby has your last name. I mean the bio father is rarely in pic so why should you change the baby's name to give him his bio fathers. So do what you want don't listen to him.

Give the child your last name because as I understand it, he was concieved out of wedlock. Then, as he gets to know the father and the fiancee, let him decide if he wants to change it as he gets older.

I know of two people who have changed their last name since they got older, it's not that uncommon, just an inconveninece for others.

Is the biological father raising the child? A mark of the father is the one who raises him not the one who conceived him. If it were me I would leave the child's name as it is. Then when the child gets old enough let him decide for himself.

Leave things as is, less confusion when he starts school. It would be different if the dad seen him and supported him on a regular basis.

No, leave that choice to your child. He may start asking for his name to be your fiance's name later in life. His name, his decision.

Give it the dad's name who is there everyday.
