As we were moving out of our place, our landlord had my car towed and impounded by the company his (my landlords) brother works for. His brother did this as a personal favor to him. The impound bill is upto 1200.00! What legal recourse do I have? Where can I go to obtain the proper forms, publications, etc. to get my car back without having to pay this unjust impound bill. Did I mention that we were illegally evicted? And that our landlord stole over 25 thousand dollars of our personal property during this move out?

You are making claims that would have to be proven in order to get your property back. You will have to prove that your car was legally parked at the time it was towed, that you were illegally evicted and that your landlord stole personal property from you. Your landlord will be on the other side, attempting to prove that he had a right to legally take and hold your property. You need a lawyer for this one. Individuals do not have the right to impound cars. The city or county government would be the legal body that would do that. An impound must be done for a legal reason. Your landlord is not empowered to just take and hold your car. There has to be some justifiable cause for this.

What state are you in? Eviction is a legal term, was it done thru the courts?

If the private property was not your property the owner had the right to have the car towed. Storage fees are set by the county (in CA anyway) but average around $200 a day. Everyone pays it, even if your car was stolen and the police put it there for you to retrieve. You also need to know that if you do not get the car it becomes the property of the tow-truck company after a set time (I think 30 days).

Was the car parked on a public highway, or illegally parked on the landlord's property? If it was parked illegally, he has a right to have it towed, especially if there is a sign to that effect on the property.

Hire a Lawyer. If your were eviicted properly through the courts and your final day has passed then there is probabaly nothing you can do.

If you were parked illegally, the landlord was within his rights....just pay up.
