My girlfriend and I were together for over 2 year already. I was very much in love with her. She is in love with me also. I started dating her since she was a freshman and I was a senior. Now, she is a junior and I am in college. 5 days ago, we had sex. 2 days ago, I broke up with her because I caught her cheating with another guy. I was very heartbroken when I saw her with him. and now, she is going to charge me for statutory rape. But I wasn't forcing her to have sex with me. It was a mutual decision. During the act, she never told me to stop. I just hope that she isn't pregnant for what I did though.

Here is the problem (for you). A person underage (and it varies from state to state) is not considered legally capable of giving consent to have sex. It is set out in the law (statute) and that is why having sex with someone underage is considered "statutory rape". In short, if you are overage, and the person is underage, you have committed statutory rape if you had sex--game over. No consent, no 'she said it was ok', etc. Short of being married at the time, you are pretty much guilty as charged (and it is not a very difficult crime to prove in court either).
You need to seek some legal advice. You said you were in college--most universities have a 'legal services' office which provides free or low cost legal advice to students. Check your school and see what they have. If not, consider a public 'legal aid' office (they are in the phonebook). Finally, if that is not an option, see if there is a criminal defense lawyer (again, the phonebook) that you can talk to. Many will waive the initial consulatation fee so you don't have to pay unless you really need them.
Gather together any evidence you have (i.e. love letters, etc) as it may be needed if she goes forward.
I would also recommend breaking off all contact with the girl if she is threatening legal action. While your heart is broken now, it's better to let things be rather than talk to her, get in a fight, and get her in the mood to call the cops out of spite. Might be better to let sleeping dogs lie for now.

She is most likely just threatning you. Just stick to being honest and i dont think she can get very far with rape charges considering you were together for 2 years. Good luck! (I hope she isnt pregnant also)

i cant say whether she is just trying to scare you or not but just in case i would get a lawyer and a really good one......i hope she isnt pregnant either......also try and see if you can prove your were together that long and that there was no force in the relationship.....i also wouldnt talk to anyone about this until you talk to a lawyer.......words can be twisted and that can hurt you in the long run good luck

It's a she said he said...time to get an attorney...they way the public percieves rape these days...you may end up arrested and booked..and hopefully you can post bail.
If she claims she was drunk or drugged and you took advantage of that would probably be her only accussation.

i think that you need to get an attorney and fast! you will be guilty until proven innocent and sorry to tell you, most jury's believe the women...
it will be her word against yours (think the wake forest La Crosse team here)
