i have been found guilty of benefit fraud before you judge me i dident do this crime i want to know can i apply for home detention before im sentanced the ammount is for 24,000 which will be split in to two half for me and half for my partner but the judge wants us to go to jail for somthing we dident do help how do i keep myself from going away ive go four kids and one on the way im really scared my sister in law was the one who started this for me she works in winz and now that ive been found guilty she has quit her job and got one higher an fraud investergater i feel set up does this sound funny to you she need this for her new job what can i do

Well… I suppose you could always consult with your attorney for the possibility of seeking out that alternative of home detention. However, after reading all of what you have written here, all of this seems contradictory and self-incriminating to me. I am not trying to say you did or did not do anything. Yet, you claim that you did NOT do this crime, however, you are opting to try to acquire a somewhat easier sentence as opposed to standing your ground and claiming “not guilty” and just proceeding to trial with your case and allowing a judge to adjudicate on the matter. You should have the option of appealing to a higher court.

You also say, “my sister in law was the one who started this for me…” as if attempting to place the blame on her? In either case, it at least appears (and this is strictly from your own statements) that whatever transpired in this series of unfortunate events does AT LEAST have something to do with you – whether intentional or unintentional. I can just suggest you stress this serious situation to your legal counsel and I am sure that just as I do not find this funny (as you asked earlier) your attorney will not either, and be very serious to this matter. Unless, this does just happen to be some ridiculous joke.

Do you have any other convictions on your record? The court may take into consideration your minor children if you do not have a prior record. Did you plead your case, as stated above, at your trial?

Frankly with an amount like #24,000 its a little hard to believe that you were an unwilling participant. You are going to have to work long and hard to convince the court that you should not serve any time.

If found guilty already you are the mercy of the court. Let's hope your lawyer didn't upset the judge during the trial.

appeal....or at the very least, make a plea before sentancing for leniency....it may or may not work depending on the arena your trial has been set, i.e., if your in a major city with liberal values than it is possible, but if your stuck in some backwater village, probably gonna have to bite the bullet
