If someone with children from a previous union remarries, can the state use the new spouse's income to determine child support - if it is a non-custodial parent - the child does not reside with the parent and new step parent? How can protections be built in if needed?

In NY a new spouse is not responsible for the child or child support. Check with a lawyer in your area

It depends on the laws in your states. So you are saying if you have kids with a man..then you go off and marry another man but still want child support from the guy who fathered your kids. Yes if you are legally married to the new guy you live with they will include his earnings as well to see how much you get. If you and the new man make more than what the old man makes you will get WAY LESS child supposrt. You really need to talk to someone that really knows what they are saying. All states are different so we really cant give you advice

Depends on the laws in the state you are residing in. Please call an attorney (some of them offer a half hour free consultation). In the state I'm in, I've heard of two different answers. One, the new spouse's income was included, in the other, it was not. Don't know why either. But it depends. Take care.

It would depend on the state.
Most states only consider the parents income, not their spouse.

yes. that is why i did not marry my ex bf. there was no way in hell some trifling lady was gonna spend my hard earned money...........and there were other important reasons as well. (he was a looser),. seek some legal advice.

yes it does seen it done many times.... just make sure you know what your gettin into.. and you cant do anything about it if your married:) sorry to have to say it:)
