well, the people elect the president and the president has to answer to the people... so it would seem that the people are the government... and that's how this country was meant to be... but the president pretty much has to do just enough to keep himself from being impeached... especially a lame duck president who doesn't need to worry about reelection... he can do anything he wants... if they're in the last year of their presidency, they can do anything (short of murder) and get away with it because an impeachment hearing would take too long: they'd be out of office before the impeachment could remove them from office. About the only check on the lame duck president's behavior is his political party who wouldn't want the bad name from the president's behavior... but how much power over a president would they have anyway?

the answer to your question is dependent upon the time-frame. Prior to January 2001 the government was by the people. Since January 2001, government has been by the president (and his evil cronies). If you enjoyed the government by the people arrangement I recommend that you vote Democratic in the next election.

Legistlative - The Senate and Congress (officials of the individual states elected by the PEOPLE)

right now the people are not in control, we didnt even have a real vote last election,
