another caseworker on our case told us the 1st one should have never removed our children from our home and that she didnt file the proper paper work to do so ..but our kids were removed from our home and sent to my mothers house 3 hours away while in her care DCS never call to check on them like the caseworker said she would and she also told us she would be at our home on tuesday(this bgan saturday night the kids were removed then) she never called or showed up until thursday of the next week..the new caseworker doesnt understand some of the things that went on or why the other caseworker did what she did now the old case worker put in a request for court order supervision on our kids (all this b/c i reported my oldest son being molested by a family member(a distant cousin) but they are treatin me and my hubby like its our fault and still havent talked to any other kids claiming that they were also molested by the same man ....this is in tennessee

the children werent removed b/c they were molested ...i reported the abuse and they said i didnt the right thing the children were only removed for 2weeks and then came home ..our new case worker told us they should have NEVER been removed without a court order ( & at the time there was no court order) we havent even appeared in court yet and they havent investigated the molestation claims.Theres an order of pretection againist the guy who did this and we took all the right steps ..we are speakin to a lawyer tonight b/c our rights and our childrens rights were violated..DCS around here arent doin things by the books and thats whats most important..there are too many gaps in paper work and no paper work were there should be ..thanks

O.K. here's the deal the DCS has a right to get involved when a child has been abused. Now the way that it is looked at is the child has been molested and was there anything that the parents could have done to prevent it from happening. If one of your children has been molested then all the children will be removed from the home because they too would be or were in harm of beng molested as well. Now you as parents may not have known what was going on but if you did and allowed the family member to continue to have contact with one child then all the children would be removed from the home.

As far as the supervision that's going to be in place most likely until the court date that you guys should have. Like I said earlier if the family memeber molested one child then all the children are or were in danger and the way that the agency looks at it is this way, if the parents know the a child has been molested then what did they do to protect the child? Did the parents call the police or alert anyone about the molestation? Did the parents stop any and all contact with the molester and the child? If you knew about the sexual abuse and did not report it then it looks as if you are not protecting the child and if the sexual offender continues to have contact with the child then again it shows that the parent are not protecting the child.

As far as the caseworker the only thing that you can do is file a formal complaint with thier supervisor or the actual agency but let me tell you this even though the caseworker in your opinion has not held up their end of the bargin as not coming to the home to check on you or going to the home to check on the kids then again this is something that you can file to the supervisor. Now just because the actual caseworker did not check on the kids does not mean that no one checked on them. In some cases if the child is not in the same area another worker from an agency can also do a courtsey check.

Whatever you do make sure that you get the court dates and make sure that you are there. This is very important that both of the parents be there because it shows the judge that you are interested in the care and safety of the child. Another thing you should be very greatful that the children are at least with a family member because their are some cases where it doesn't happen and the children end up in foster care.

Make sure that both parents complete any and all services that the agency asks you do complete and get it done as fast as possible. Now some of the things may be an inconvience but you still have to do them. And make sure that you document everything and I mean everything. Ask questions if you are confused about anything because that's wha the caseworker is there for.

I'm in Texas and love doing this job and love helping familes when I can I've seen it all before and my best advise to the both of you parents is hang in there and keep the faith.

im so sorry too hear ,ive went throu the same thing only no family support the first thing you need to do is on your first court date ask for a new case worker if they dont make your oppointments document them dont ever miss a visit and most important thing get your own lawyer not court oppointed

I'm sorry for what is happening to you but your son was molested under your watch and they want to make sure you didn't play a role in it.

First you get a lawyer if you can't afford one you call legal services and get one pro bono,they work free.
