My family and I were on vacation in Florida during March of 07 when one night my dad got pulled over. The police officer informed him that there was a warrant for his arrest from Ohio (where we used to live) for open dumping. They said the warrant was issued on September of 06. They arrested him and said it was a no bond warrant. The only information we recieved was the open dumping took place on some property we used to rent. We moved from that property in august of 2005. My question is how can they issue a warrant for that when we havent lived there in over a year? We were not informed there was a warrant out for his arrest either. There have been so many other people on that property since we moved. What is Open Dumping? The only thing we could think of is a sewer line breaking. Also we lived in ohio at the time this warrant was issued so why didnt they come get him or send a notice? Basically he is being falsley accused. They have no proof of this open dumping. What can we do?

Yes. The statue of limitations had not expired.

The Ohio court issued the warrant based on the information available to it. And just because it was issued in Sept 06 doesn't mean that the alleged offense occured in Sept 06.

The warrant only compels attendance at trial. It's not a conviction. To be convicted of a criminal offense, the prosecution would need to prove the crime beyond a reasonable doubt, and your father would be able to assert his non-ownership of the property as a defense.

Yes, pay the fine. This is a horrible country with the citizens having no rights what so ever; haven't you been reading the posts? I'm sure this is a republican plot by Bush to get money from the working class. Don't fight it, just pay up, you'll feel better.
