ok if a father knew he had a son but made no effort to see the child for the 8 years the child has been alive....could the court terminate his rights under the abandonment law? His name isnt on the birth cert .

Did you read the question before shooting off at the mouth??? I said he knew the kid was his...and the reason he was not on the bc....because he was too busy screwing the other girl he knocked up too....yeah...I was with the loser for 3 years before he got me preg and decided to cheat on me too...He has made no contact for 8 years....even tho he knows he fathered a child..If he wanted to be a dad...he knew where we were....where was he??? on drugs or in jail....So stop with the poor dad crap...geez..

The gross neglect of a father to locate for his child is abandonment and it could terminate his paternity rights over the child as provided for in the Civil Law.

No way, dads rule!!!
If I were the dad I would be suing for kidnapping my kid. Why in the world isn't his name on the birth certificate? What kind of a woman steals a mans child and doesn't even tell him that the kid was his. For all he knows it could have been the postman's or the crack dealers down on the corner! Lets gets some facts ladies before we condemn the dude.

Reply: Not shooting off my mouth, maybe venting a little at the poor me tone of the question. I know quite a few women that have a child while in a relationship and don't know who the father is. The father doesn't have to be present to be on the birth certificate. He wasn't on there for one reason; at the time of birth the mother didn't want him listed, ether because she didn't know who the father was or didn't want the father involved. Don't act like this is totally one sided. The guy is probably a creep but guys are constantly getting railroaded by the courts and one-night-stands. The only way to make sure he's out of the picture (and see how the child feels toward you, especially if the kids a boy, when it hits 14 or so) is to go to court, I'm sure you'll find a sympathetic ear.

There is no abandonment if the guy was never listed as the legal father, he will have to go to court and prove the kids his to get visitation rights. If he is such a deadbeat I doubt if he will pay the court costs and blood tests for such a case. You are borrowing trouble.

i'm involved by the abandonment regulations ~ i think of that this is greater desirable than having some under pressure out make certain go away there youngsters in an best chum or trash can. I merely think of they ought to alter the regulations somewhat to the place in case you you do provide your infant away then you definately won't have the capacity to have it back. those places are not daycare centers they're places to good provide up your new child. infants are not toys

You could and you'd win but if he is not on the BC and has had no contact.....What's the point? In effect he already is terminated. If he wanted visitation or anything else then I'd make him pay the lawyers all the money, you'd still win.
