"Technically" subliminal advertising is illegal in the US, however, there are some techniques that are used in advertising that are less subliminal and more of a subtle message. The "extreme" Mountain Dew commercials come to mind. Mountain Dew doesn't make you feel like you're jumping out of an airplane, or riding a mountain bike down a huge mountain, but the commercials make you feel like that.
Although, there are other venues that use subliminal messages. One that I know of is the music that gets played in various stores, Kmart to name one, that tell the shoppers things like 'don't shoplift' and 'you really want what you're looking at right now'. Other ways that they are used, is in tapes that you can buy, with 'stop smoking' messages, 'eat less, exercise more' messages, and the like.
There has never been a comprehensive study that subliminal messages work, however the fact that a company like Kmart uses them says something about their reliability.

Subliminal messages don't work, but pushing the envelope on "acceptable" dress, language, and behavior in the media has its impact on the public view of what is to be considered normal along with the admonition that we should not be judgmental. In the old days, judgment was a good thing..
