My next door neighbor flushes the toilet about a hundred times a day--I have this on my tape recorder. I told and played the tape to my landlord and talked to the lady personally--who told me that the toilet is really loud when you flush it. Now her constant toilet flushing is stopping up my toilet, sink, and bathtub in which I have had maintenance come to my room several times to fix.

Have some sympathy for someone who cannot control their bladder. Have your landlord move you to a different apartment.

The issue is with the landlord, not the neighbor. Your landlord is required to take steps to minimize the problem, as it's an issue with the structure of the building. The neighbor can flush her toilet as much as she likes. If the landlord can't alleviate the situation, you'd have the right to break your lease. You are entitled to 'quiet enjoyment' of your apartment.

Her flushing, however, should have no effect on your plumbing unless she is flushing big wads of toilet paper or other materials. No amount of excess water in the drains is going to stop it up.

No one should need to use the bathroom that many times a day. If it is causing you problems, keep on your landlord. It's their job to keep things running in your apartment. I would play her the tape and ask her to flush less. If it's yellow let it mellow...

Give them a gift basket filled with mylanta and pepto bismol. And buy yourself some earplugs.
