well i let a so called friend borrow 1000 dollars...during the 5 months he has only given me 200 bucks...i have signed receits by him...but all i have is his home number which he never picks up.... i dont know where he lives how would i be able to take him to court?

You would need to find his mailing address, which you can do using his phone number. Either hire a PI, or use one of the reverse phone-number directories that are available.
Once you have his address, you could talk him to small claims court.
Whether you should is a social, not legal, question.

First send him a registered letter... meaning he will have to sign for it. You can make it look like it is written on an attorneys letter head/ stationary, that will usually get a responce.
To get his address, either call directory assistance, and give them the number for a reverse look up. OR go to whitepages.com and click on the link for reverse number lookup. Hope that helps.
About actually taking him to court, I dont really kow much about. Since the amount you loaned was under $5,000, you can take him to small claims court. Check you local listings, and see if their is a lawyer you specialises in that sort of thing. Most will give a free consultation. BUT you may not get any money back, plus you will be out the cost of court costs.

It will be tough if the # is to cell phone, but if it home phone and listed you can call 411 for home address. Do not get a PI it will cost you more paying his fees. Filed a small claims sue in his city and the court will deliver the sue by process server, there will a fee in the filing and for process server. If your friend had any dealings with the city i.e traffic violations or any filings they could have a address.

The court can help you track down the information needed to serve this loser with papers. If you have his phone number then you CAN find his address. Put his last name and phone number up, along with his city and state and I'll dig it up for you. I'm quite good at finding people! Let's see if I can do it.
**OKAY...most of the U.S. has each county's property apprasiers records online, meaning with a name you can find the persons address, their family's address, look at their property's value, etc. Unfortunately the state of California is charging a $75 fee plus $100 an hour to search their site and you have to tell them WHY you want to look at their records. In other words I was unable to find anything except CA has made it very hard to find out anything without spending a small fortune.
I called information in Lawndale, provided them with the name, phone number and zipcode but they DID NOT give me the address - I even said the person was a long lost friend, no luck. So this is the first time I have had no luck and now I know the state of CA isn't big on online information. So, my next recommendation is to go to your county courthouse, tell them you want to sue this person, here's their name and phone number. If it's in their public records they should be able to give you the records or some useful information. Most of the people that work at the courthouse in the records department are very used to finding information, I used to do that, so ask for help.
You have just cause for looking at records at the city/county courthouse offices and while you're there you might be able to get the ball rolling on your suit to get your money back. Save very receipt, scrap of paper, get people's names and have your records straight for court.
I typically search by last name only and the results will give the person in question and possibly relatives of theirs, with their physical address, mailing address, property values, etc. That way when you go to court you know what assets they have, what their wives own, if they have multiple properties,etc.
Sorry I couldn't get the info for you!! You can only search by address, not last name, at the LA county site. If by any chance any of my friends in CA can help, I'll post again.

ever heard of a bonded warrant........you can swear out a bonded warrant for the amount that he owes you.....police pick him up put him in jail and he does not get put until he can pay the amount to you......Question....why would you loan such an amount to some one that apparently did not know well enough to know where he lived or any other info.
Good luck, but you may have to chalk this on up to lesson learned....$5,000 sure is an expensive price to pay....bet there would have been ppl on here who would have done it for a say about $100-$200. Far cheaper than the 5 it cost you.

Then you need to do a reverse phone search and find out where he lives if that is a home phone , not a cell phone.
but you loaned someone 1000 dollars that you did not know where they lived ??
