I told my bf his little 12 year old brother (will be 13 in a week)tries to touch me, and he said hed take care of him if he touched me again........a while after i talkedd to his little brother and he apologized and started crying that i was the only person nice to him and stuff..............then he kissed me...was is it an act? and should i tell my bf?

I think that you should be honest and open with your boyfriend. He needs to be aware of what his little brother is doing. I think that it was an act.
Remember honesty is important.
