There is a prexsisting alley by my house maybe 6' away. I am afraid that my kid is going to get hit and want to annex it to my property so that only we can use it. Any help would be greatly approciated with any assistance.

Look in your title insurance papers for easements granted to the city. That will establish the boundary limits for the alley. Getting the city to remove the easement will be difficult and require the efforts of all property owners affected by it. If theres a sewer main or water main under it, or if the garbage truck picks up refuse along it theres little to no chance of closing it. If it only affects your property you may get a variance and have it closed off. Take this issue to your city for resolve after examining your parcel info for easements granted.

Try the county assessor web site to see if that alley is a existing path to access another property or an encumbrance recorded to access some sort of underground utility service. If it is not then find out who owns that land and ask if you can buy it. If none of those options work then you would have to stake a claim on the land and that could take up to five years or more. Then you would file a claim on it at the assessors office. Even then it not certain that you will get that land. Your better of making your kids well aware of the dangers of playing in that section of land.

never heard of annexing an alley. it is public domain or it could belong to the other businesses or properties. noone is going to give up their access. Try a fence.
